VideoFX Terms of Service — AI-Powered Services

Welcome to VideoFX. VideoFX is operated by Liang Yaoqiang, an individual operating under the laws of the People's Republic of China ("VideoFX", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of our AI-powered video generation services available at https://videofx.io (the "Service").
By creating an account, subscribing to any plan, purchasing credits, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood, and agree to be bound by these Terms; (c) agree to our Privacy Policy; and (d) are authorized to enter into this agreement on behalf of yourself or any organization you represent.
Important: If you do not agree to these Terms, you may not use the Service. Continued use after any update constitutes acceptance of the revised Terms.
VideoFX provides an AI-powered platform that enables users to generate and edit videos, including text-to-video, image-to-video, reference-to-video, video editing, and motion control. The Service is a digital software-as-a-service (SaaS) product delivered via the internet.
The Service is a digital, intangible product. Upon confirmed payment, access and credits are granted immediately. Due to the immediate digital delivery, specific limitations apply to refunds as described in Section 7.
VideoFX is an independent product. It is not affiliated with, endorsed by, or operated by any AI model developer. Videos are generated with the following third-party AI models, which you can see and select by name in the generator:
Service performance and availability may be affected by the operational status of these models and the providers that host them. We will endeavor to communicate significant disruptions in a timely manner. All content produced by the Service is generated by AI.
To use the Service, you must create an account by signing in with Google and provide accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
If you register on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
The Service runs on credits. Each video generation consumes credits according to the model, mode, and settings you choose; the cost is shown before you generate, and credits are deducted when you start a generation and are automatically returned if the generation fails.

For current plans, credit amounts, and pricing, please visit our Pricing page. We may modify plan features or introduce new plans at any time; changes to the price of an existing subscription are governed by Section 5.1.
To keep the Service stable and fair, generation may be subject to usage limits that vary by plan.
By subscribing to a paid plan, you expressly authorize us, through our payment processor, to charge your payment method on a recurring basis for the applicable subscription fee at the start of each billing period until you cancel in accordance with Section 6. Your subscription renews automatically at the end of each billing period unless cancelled. If we change the price of your plan, we will notify you before the change applies to your next renewal, and you may cancel before it takes effect.
Each credit pack purchase is a one-time transaction. By completing a purchase, you authorize the charge for the amount displayed at checkout. The Service does not offer automatic top-up.
Payments are processed by our payment processors Waffo Pancake and Creem, which act as the merchant of record for your purchase. Payment card data is handled exclusively by these PCI-DSS compliant processors and is never stored on our servers. Your processor emails a receipt for every successful charge, and Waffo Pancake also emails a reminder before each subscription renewal. Because the processor is the merchant of record, the charge on your card statement may show the processor's name rather than "VideoFX".
Prices are exclusive of applicable taxes (including VAT, GST, sales tax, or similar) unless otherwise stated. Where required by applicable law, our payment processor calculates and collects applicable taxes at checkout.
You may cancel your subscription at any time:
Cancellation stops all future renewals. Your subscription and its included credits remain available until the end of the current billing period, and you will not be charged for subsequent periods. Credit packs purchased separately are not affected by cancellation and remain subject to their own validity period (Section 7.4).
Refunds are governed by our Refund Policy, which forms part of these Terms. In summary:

Credits included in a subscription plan are valid for the period stated on the Pricing page and do not carry over: when a new billing period begins, unused credits from the previous period expire.
Free credits granted at sign-up are valid for 30 days and have no cash value.
Separately purchased credit packs keep their original validity period (365 days from purchase, unless stated otherwise at checkout) regardless of your subscription status.
When you hold credits from more than one source, the credits closest to their expiry date are used first.
If you believe there is an error in a charge, please contact us at [email protected] before disputing it with your bank. We commit to responding within 2 business days and resolving confirmed billing errors within 5 business days.
Subject to these Terms, AI-generated content produced in response to your inputs ("Outputs") is owned by you. You may use Outputs for any lawful personal or commercial purpose consistent with Section 10.
By submitting prompts, images, or videos to the Service ("Inputs"), you grant us a limited, non-exclusive license to process your Inputs solely to deliver the Service. You must own or have the necessary rights to all Inputs you upload. We do not use your Inputs or Outputs to train AI models.
Outputs are generated by the third-party AI models listed in Section 2.3 and may be influenced by those models. We do not guarantee specific output quality and accept no liability for outputs generated by third-party models.
AI-generated content may contain errors, artifacts, or inaccuracies. You are solely responsible for reviewing Outputs before using or publishing them, and for disclosing that they are AI-generated where required.
We retain all rights to the VideoFX platform, brand, and interface. You may not reverse engineer, copy, or redistribute the Service.
This section is our content policy. It applies to every prompt, upload, and Output on the Service.
You may use the Service only for lawful purposes in accordance with these Terms.

If you see content generated on VideoFX that violates this policy, email [email protected] with the subject "Content Report", a link or description of the content, and the reason. We acknowledge reports within 2 business days and act on confirmed violations promptly. Reports involving child safety are handled with the highest priority.
Depending on the severity, we may remove content, block requests, suspend or permanently terminate accounts, forfeit remaining credits obtained through or used for violations, and report illegal content to the relevant authorities. If you believe an action was taken in error, email [email protected] with the subject "Appeal" and we will review it.
Your use of the Service is governed by our Privacy Policy. Payment card data is processed exclusively by our PCI-DSS compliant payment processors (Waffo Pancake and Creem) and is not stored on our servers. When you ask us to delete your account, your account data and generated content are deleted within 30 days, except records we must keep by law (see the Privacy Policy).
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF AI OUTPUTS.
AI GENERATED CONTENT DISCLAIMER: Outputs may be inaccurate, incomplete, or unrealistic. Do not rely on them for legal, medical, financial, or other professional advice. Always verify AI-generated content before acting on it.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIDEOFX AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or content you generate or upload.
These Terms remain effective while you use the Service. We may suspend or terminate your account if you materially breach these Terms, we suspect fraudulent activity, or as required by law. If we terminate for reasons other than your breach, we will provide a pro-rated refund for any unused prepaid period. You may delete your account at any time by emailing [email protected] from your registered email address.
These Terms are governed by the laws of the People's Republic of China. Before initiating any formal proceedings, please contact us at [email protected] to attempt informal resolution. Nothing in this section limits any mandatory consumer protection rights you have under the laws of your country of residence.
We may update these Terms from time to time. Material changes will be notified by email or by a notice on the Service at least 14 days before they take effect, and the version and effective date at the top of this page will be updated. Continued use after the effective date constitutes acceptance. If any provision is found unenforceable, the remainder continues in full effect.
